Terms of Service - Flamingo Lockers

1. SERVICE DURATION AND LOCKER ACCESS

The FLAMINGO LOCKERS service is contracted by days, according to the dates selected by the user during the reservation process.

During the contracted day or days, the user may open and close their locker as many times as needed, always within the opening hours established for the premises.

Renting a locker does not imply access to the establishment outside of said hours. The user must check and take into account the closing time before leaving their belongings in the locker.

2. CLOSING TIME AND LUGGAGE COLLECTION

It is the sole responsibility of the user to remove all their belongings before the establishment's closing time.

Once the premises are closed, no extraordinary opening service or assistance to recover luggage is guaranteed until the next opening.

If the user leaves their belongings inside a locker after the access hours have ended, they must wait until the next opening of the establishment to retrieve them.

When the stay of belongings exceeds the contracted period, FLAMINGO LOCKERS may charge the additional time or corresponding expenses before proceeding with their delivery.

3. FLIGHTS, TRAINS, TRANSFERS AND OTHER COMMITMENTS

The user must arrange the collection of their belongings with sufficient margin, taking into account the establishment's hours and their subsequent travel.

FLAMINGO LOCKERS will not assume any costs or damages arising from the user's inability to retrieve their belongings on time due to arriving after closing time or without sufficient margin, including, but not limited to, loss of flights, trains, buses, reservations, accommodations, taxis, transfers or other contracted services.

It is especially recommended that users who have a scheduled flight, train or other transport remove their belongings well in advance.

4. TECHNICAL INCIDENTS AND CAUSES BEYOND FLAMINGO LOCKERS' CONTROL

The operation of the premises and lockers may depend on electrical, electronic, computer and telecommunications systems.

In the event of an incident, FLAMINGO LOCKERS will take reasonable actions to restore the service as soon as possible.

However, except when there is legally attributable liability on the part of FLAMINGO LOCKERS, the company will not be liable for delays or temporary impossibility of access caused by circumstances beyond its control, such as power outages or failures, Internet or telecommunications interruptions, incidents with external technology providers, unforeseen breakdowns, general failures of networks or public services, force majeure situations or unforeseeable circumstances.

In these cases, FLAMINGO LOCKERS will also not assume indirect costs arising from the incident, such as loss of flights or transport, new reservations, accommodation, taxis or other personal expenses, except in those cases where legally applicable.

5. RESPONSIBILITY FOR BELONGINGS

The user is responsible for checking that the locker is properly closed and locked each time they deposit or remove belongings.

FLAMINGO LOCKERS will not be liable for losses, misplacements or thefts resulting from a locker that the user has left open or incorrectly closed; from the loss, disclosure or use by third parties of their codes or credentials; from access authorized by the user to third parties; or from failure to comply with these conditions.

The existence of video surveillance systems constitutes an additional security measure and does not constitute an absolute guarantee against robberies, thefts or damages.

Nothing established in these conditions will exclude those responsibilities that legally correspond to FLAMINGO LOCKERS.

6. VALUABLE ITEMS AND PROHIBITED ITEMS

The lockers are mainly intended for the temporary storage of suitcases, backpacks, bags and ordinary personal travel effects.

They should not be used to store cash, jewelry, documents of special value, luxury items or other goods whose value is disproportionate for an ordinary luggage storage service.

It is expressly forbidden to introduce weapons, explosives, flammable materials, illegal or dangerous substances, toxic, corrosive or contaminating products, animals, perishable food, illicitly obtained objects, items whose possession is prohibited or any object that may cause damage, odors, dirt or nuisance.

In the presence of reasonable indications of dangerous, illegal content or content that may affect security, FLAMINGO LOCKERS may adopt the necessary measures and, where appropriate, report the facts to the competent authorities.

7. ACCESS CODES

The codes, keys or access systems provided to the user are personal and remain under their responsibility.

The user must keep them confidential and must not share them with third parties outside their reservation.

FLAMINGO LOCKERS will not be liable for access by third parties when this has occurred using the credentials correctly provided to the user, unless there is a cause legally attributable to the company.

8. RESERVATION END AND UNCLAIMED BELONGINGS

At the end of the contracted period, the user must completely remove their belongings and leave the locker empty and in good condition.

If objects remain inside once the reservation has ended, FLAMINGO LOCKERS may temporarily block the locker and contact the user.

Costs arising from the additional time of occupation, management, removal, custody or return of the objects may be charged to the user when legally applicable.

If after a reasonable period the belongings are not claimed, proceedings will be carried out in accordance with applicable legislation.

9. DAMAGE TO FACILITIES

The user must use the locker and the rest of the facilities correctly.

When damage occurs due to negligent, improper or intentional use, FLAMINGO LOCKERS may claim from the responsible party the actual cost of repair or replacement, as well as the damages directly caused by the impossibility of using the locker, when legally applicable.

10. PRICE AND PAYMENT

The applicable price will be the one indicated during the reservation process according to the size of the locker, the selected dates and the rates in effect at that time.

Payment will be made through the systems enabled by FLAMINGO LOCKERS.

Any extension of the initially contracted period will be subject to availability and payment of the corresponding fee.

11. RESERVATION AND SERVICE OPERATION

When making a reservation, the user will select the dates and the type of locker available, provide the necessary data and make the corresponding payment.

Once the process is correctly completed, they will receive the necessary instructions or credentials to access the establishment and use their locker.

It is the user's responsibility to check sufficiently in advance that they have the necessary information and codes to access the service and contact FLAMINGO LOCKERS if they detect any incident.

12. APPLICABLE LAW

These conditions shall be governed by Spanish law.

Any dispute shall be resolved before the courts and tribunals that are competent in accordance with current regulations, in all cases respecting the rights legally corresponding to consumers and users.
